Judge Preventing Trump's HHS Restructuring Is Focused on Race

A judge recently ruled to halt the Trump administration’s changes at the Department of Health and Human Services (HHS), and her judicial history shows that President Joe Biden supported her nomination partly due to her background as a person of color and her status as openly LGBTQ.

Justice Melissa Dubose was appointed by Biden in 2024, after being recommended by Senators Sheldon Whitehouse and Jack Reed. Notably, Republican Senators Susan Collins and Lindsey Graham also voted in favor, resulting in a narrow confirmation.

Press releases from the White House highlighted Dubose’s historic appointment, marking her as the first person of color and openly LGBTQ judge to serve on the US District Court for Rhode Island.

However, during her vetting, it was noted that Dubose appeared unfamiliar with key Supreme Court precedents that could guide her decisions, specifically concerning national injunctions. Nonetheless, her recent injunction was initiated by a coalition of attorneys general from 19 states and Washington D.C.

Date records raised questions, particularly regarding her previous statements about her past “Marxist stage” and her lack of candidness during her Senate survey.

In her responses, Dubose revealed her involvement with the National Consortium for Racial and Ethnic Equity, where she participated in discussions focusing on racial justice and systemic bias within the legal system.

She held roles within various committees dedicated to racial equity in Rhode Island’s courts, which included training programs on implicit bias for legal professionals. Dubose’s activism also encompassed participation in panels addressing diversity and equity in legal settings.

During her confirmation, Dubose openly identified as a Democrat and defended her political leanings, asserting her commitment to a democratic system.

Her status as the first person of color and openly LGBTQ judge in Rhode Island is significant, potentially influencing her appointment. The White House emphasized the importance of diversity in her nomination, viewing it as an essential attribute in the judiciary.

Organizations advocating for social justice echoed these sentiments, recognizing her nomination as a necessary step toward diversifying historically underrepresented judicial districts.

This recent ruling against HHS isn’t the first time Dubose has drawn attention. Previously, she ruled against a Republican senator’s request concerning social media regulations affecting women’s sports and addressed issues related to immigration law enforcement.

Dubose also dismissed a lawsuit from a couple challenging Rhode Island’s marijuana licensing rules, asserting social equity provisions.
