Justice Department Begins Criminal Inquiry Into New York Attorney General Letitia James

New York Attorney General Letitia James is currently under scrutiny in a criminal investigation involving President Donald Trump and other targets, including Breitbart News.

According to two sources familiar with the matter, James has received a subpoena. They mentioned that this subpoena is part of a broad and rigorous investigation ordered by Attorney General Pam Bondy, managed by the U.S. Attorney’s Office in New York. Although the sources did not confirm the precise U.S. lawyer handling James’ case, her office is located in Albany, suggesting that the investigation is being carried out by the upstate New York district.

While the specific details remain vague, the sources noted that the investigation pertains to issues of disenfranchisement. The Department of Justice’s Civil Rights Division website clearly outlines laws relevant to this subject. It states that, “Section 242 of Title 18 makes it a crime for anyone acting under the color of law to knowingly deprive a right or privilege protected by the U.S. Constitution or federal law,” which emphasizes the seriousness of such violations.

The DOJ site further explains that, depending on the circumstances, a conviction could potentially lead to severe penalties, including life imprisonment or even the death penalty.

Under Section 242, “conduct under the color of law” encompasses actions taken by federal, state, or local officials within and beyond their legal limits. This definition applies to a range of public servants, including police officers, prison guards, judges, and health care providers.

While it’s uncertain if James is facing a specific charge related to this law, sources indicated that the investigation concentrates on incidents of disenfranchisement linked to Trump. Federal subpoenas typically cite specific laws, but the details of those documents have not yet been released.

These developments come on the heels of reports from May 2025 that James is being investigated by the FBI for alleged mortgage fraud, placing her under multiple criminal investigations from federal authorities.

James made a name for herself with a campaign focused on holding Trump accountable, and this ongoing series of investigations could yield significant opportunities for her. In a book by Breitbart News Editor-in-Chief Alex Marlowe titled Break the Law, she reiterated her commitment to pursuing Trump.

Marlowe’s recent work highlights how James has taken an aggressive stance against Trump, framing it within a political context underscored by her statements to Democratic audiences.

Letitia “Tish” James is a partisan Democrat who entered the Attorney General’s race with the intention of targeting Trump. She has been quite open about using legal avenues to achieve political goals, often communicating her enthusiasm about the work.

Moreover, Rep. Elise Stefanik (R-NY), who previously served as chair of the House GOP conference, sent a 64-page letter to the New York Commission on Professional Standards requesting action against James over at least 50 instances of biased comments she allegedly made targeting Trump during various lawsuits leading up to the New York state presidential election.
