Justice Department Investigates MLB Over Religious Objections to Pro-Pride Messages

Will Cain discusses how sports, religious freedom, and LGBTQ+ pride intertwine. Recently, a minor league team forfeited a game after players declined to wear Pride jerseys. Simultaneously, the Department of Justice is examining Major League Baseball’s actions regarding a San Francisco Giants player who displayed a Bible verse during Pride Night. This raises questions about whether federal law mandates employers to accommodate religious beliefs amidst discussions about mandatory ideological expressions in sports.

The Department of Justice is also looking into the Fort Worth Police Department following a video that surfaced online. This video depicted a police officer appearing to limit a Christian street preacher’s speech based on its content. Assistant Attorney General Harmeet Dhillon from the Civil Rights Division sent a letter to the Fort Worth city attorney, Leanne D. Guzman. The aim is to determine if an investigation is warranted after the video’s implications on First Amendment rights.

Dhillon emphasized the commitment to protecting all Americans from unlawful restrictions on expression, stating that government officials must not discriminate against viewpoints or penalize peaceful expression simply because it may be unpopular or controversial. The Supreme Court has consistently upheld that governmental discrimination against speech based on its message is unconstitutional.

In a recent statement, the Fort Worth Police Department acknowledged that an officer made inaccurate statements during a virtual interaction with the street preacher at last month’s Pride festival. They insisted, however, that the citation issued was for using a bullhorn, which allegedly violated city noise ordinances, not for the preacher’s speech content.

The incident, which occurred on June 27 at Trinity Pride Fest, arose after a business owner nearby complained about the amplified sound affecting their customers. Rich Penkoski, the preacher involved, was conducting a protest speech during the event.

Penkoski noted that police suggested calling a biological male “man” could be problematic and lead to citations, while a half-naked individual was seen around children without police intervention. He shared this in videos on social media, questioning the legality of labeling something as “offensive.”

The police chief of Fort Worth commented on the need for clarity around legal and illegal speech, acknowledging that the officers could have better communicated with the preacher. The department has been trained on First Amendment rights, and the DOJ has requested documentation regarding the department’s policies and any citizen complaints about speech violations since 2015 to evaluate the situation further.

In a statement to Fox News Digital, Penkoski expressed gratitude for the investigation initiated by the Assistant Attorney General, noting that prior administrations might have overlooked such issues. He feels that while some groups claim their rights are under attack, it’s Christians whose rights are being infringed upon. He urged believers to be more vocal in exercising their rights before they are lost.

Penkoski concluded by praising Dhillon’s understanding of governmental purposes, expressing both sadness and hope about the situation.
