Judge Expresses Concerns Over Supreme Court Decision on Transgender Procedures for Minors
On Wednesday, Judge Sonia Sotomayor expressed her “sadness” about a recent ruling where children were denied access to experimental and irreversible transgender procedures.
The Supreme Court upheld a Tennessee law that bans such child sex change procedures, with a vote of 6-3. This decision has raised concerns regarding the implications for transgender rights.
“By withdrawing from meaningful judicial reviews at critical moments, the court has abandoned transgender children and their families on a political whim,” wrote Sotomayor. “In my sadness, I oppose it.”
Joined by Justices Elena Kagan and Ketanji Brown Jackson, Sotomayor supported the Biden administration’s claim that the Tennessee law infringes upon equal protection rights.
She pointed out that the law restricts hormone and blocker treatments for minors based on their identified gender, leading to a situation where those identified as boys cannot access treatments available to girls, and vice versa. “It inevitably creates disparities,” she noted.
Additionally, she compared the ruling to a historical decision by the Virginia Supreme Court, which deemed a law prohibiting interracial marriage unconstitutional, reflecting on the broader implications of governmental love versus restrictions.
“The court has rejected the nation’s call for love and understanding, choosing instead to defer to the state assembly,” she remarked, criticizing the reliance on “questionable” scientific evidence.
Sotomayor emphasized that instances of transgender discrimination are readily apparent, referencing policies from the previous administration that impacted transgender individuals significantly.
She mentioned efforts to expel transgender service members from the military and the threats to withhold funding from supportive educational institutions and nonprofits.
A report from May by the Department of Health and Human Services indicated a lack of scientific backing for the “gender-affirming” care model, noting potential risks associated with these medical interventions, including serious health complications and emotional distress.
