Key witnesses for Diddy may weaken the prosecution’s case despite dramatic testimony, according to an expert.

In the first two weeks of Sean “Diddy” Combs’ sex trafficking trial, the jury has heard testimony from various individuals, including his ex-girlfriend Kathy Ventura, several male escorts, previous supporters, and ex-Homeland Security agents.

Prosecutors have around six weeks left to demonstrate Diddy led a criminal enterprise that exploited women, including Kathy.

In 2024, Diddy faced serious allegations including conspiracy, sex trafficking, fraud, and forced transportation for prostitution.

“During the second week of the trial, prosecutors solidified Ventura’s statements through independent witnesses, highlighting key elements of sex trafficking and assault,” says former federal prosecutor Neema Ramani. “While the defense managed to score points during cross-examinations, they seem to be trailing behind.”

Others, however, remarked that the defense has effectively used the prosecution’s witnesses to bolster their case.

“The defense has been skilful in exploiting testimonies to support their theory, suggesting while Diddy might have some flaws—especially regarding domestic violence—not everyone’s experiences align with those claims. In federal court, the proceedings aren’t conducted in real-time, yet it doesn’t feel like the prosecution has sufficiently met their burden thus far,” they added.

Entertainment lawyer Tre Lovell noted that the jury encountered “consistent” witness testimonies, yet doubts lingered after two weeks.

“So far, several witnesses have portrayed Diddy as violent and controlling, particularly concerning Kathy’s conduct and feelings, but that alone doesn’t substantiate a criminal operation or a continuous pattern of illegal behavior. Kathy’s relationship might equally be viewed as one stemming from affection and professional advancement,” he explained.

On Thursday, testimony came from rapper Kid Cudi, who recounted a past romantic link with Kathy. He stated that when Diddy discovered their relationship, he allegedly invaded Cudi’s home and even set a car on fire. However, there wasn’t any solid proof to back Cudi’s claims.

“Kathy mentioned to Kid Cudi about prior assaults, yet Diddy’s lawyers highlighted that she never brought up any sexual abuse,” Ramani noted. “Cudi ended his relationship with Kathy due to concerns for his safety, suggesting Kathy was managing both him and Diddy. This is a crucial point for the defense—Kathy is portrayed as an independent woman who made her own choices, even in a lifestyle that some might label as unconventional.”

The presentation of Cudi’s testimony had its flaws, but it was still significant, considering arson is a core part of the allegations, according to Ramani.

“Kid Cudi’s claims could influence views on assault, even if no trafficking is established. The judge has the option to convict on issues like seduction or fear,” he added.

Chalet Hayes, an exotic dancer known as Punisher, spoke in court about being involved with Kathy at Diddy’s request, stating that such interactions were consensual. He explained that he sensed no discomfort from Kathy and would have ceased if he did. Under cross-examination, he reiterated that the encounters were mutually agreed upon.

“Honestly, I thought I was ready for this, but I was quite nervous,” Hayes remarked after his court appearance. “The atmosphere was intense, making it hard to focus. For most of my testimony, I could barely even locate where Diddy was sitting,” he admitted.

He also conveyed hesitation, saying he didn’t quite grasp the significance of some of his earlier statements, believing they might have actually benefited the defense.

According to legal expert Seltzer, Hayes’ testimony seemed to counter the prosecution’s narrative.

“While trying to piece together RICO allegations against Diddy, the testimonies from Hayes and Kid Cudi haven’t worked in their favor,” he shared. “Hayes reinforced that actions were consensual, and Kathy’s acknowledgment of such supported Diddy’s defense. Plus, Cudi’s reflections on past events lent credibility to the defense case as well.”

Amid the trial, Kathy’s mother, Regina, and her former best friend, Kelly Morgan, were called to testify against Diddy.

Regina’s brief testimony proved impactful, as she shared images of Kathy’s injuries sustained while in a volatile relationship with Diddy, who allegedly demanded $20,000 when he learned Kathy was seeing Kid Cudi.

“This establishes coercion—a critical factor relevant to sex trafficking allegations and RICO claims,” Ramani clarified.

Kelly Morgan also provided testimonies about witnessing Diddy’s abusive conduct towards Kathy on multiple occasions, marking her as one of the strongest witnesses in the trial.

“She observed Diddy hitting and dragging Kathy, and following one incident, he reportedly charged into Kathy’s home with a hammer. He appeared to control every aspect of her life, reflecting the psychological dynamics of abuse and reinforcing evidence of trafficking,” Ramani explained.

Prosecutors have also laid out testimonies over the previous weeks regarding Diddy’s alleged criminal activities.

David James, Diddy’s former assistant, claimed he supplied him with items like condoms and stimulants linked to the accusations, indicating ties to a criminal operation.

Another assistant testified about procuring substances for Diddy and described numerous instances of violence directed at Kathy in various settings. Such details suggest that Diddy potentially played a leading role in criminal activities.

The judge also heard insights from psychologist Dr. Dawn Hughes, who provided important context on why victims may stay in abusive situations.

“The psychologist helped address lingering questions regarding why Kathy remained with Diddy despite the coercive and abusive behavior,” underscoring the power dynamics often present in such scenarios,” they said.
