Lawyers for alleged MS-13 member Kilmar Agrego Garcia complain feds have done nothing to bring him back, despite SCOTUS order

The federal government did nothing to comply with the court order for the Salvadoran government to file Kilmar Abrego Garcia, a member of MS-13.

“The government updates do not show that measures have been taken to comply with this and Supreme Court orders,” Abrego Garcia’s lawyer filed Tuesday morning in the three-page Maryland federal courtroom. “There is no evidence that anyone requested the release of Abrego Garcia.”

The Trump administration claims that Abrego Garcia is a member of Salvador’s gang MS-13 and that he was illegally in the country despite admitting that he was deported as a result of “clerical errors.”

The immigration judge gave him protection from deportation after he allegedly claimed asylum.

Maryland resident Abrego Garcia was shipped last month to the infamous, dangerous and overcrowded terrorism confinement center (CECOT), along with 260 other reputable gang members under the alien enemy laws of the 18th century.

However, the move opposed a 2019 court order blocking Abrego Garcia’s deportation over concerns that he would have been targeted by groups like the Barrio 18 gang.

The US Supreme Court has ordered the Trump administration to “promote” the return of men.

Abrego Garcia’s lawyers are expected to sues the administration in federal court in Greenbelt, Maryland, suing his removal at 4pm.

In a paper Tuesday morning, lawyers for Abrego Garcia said the federal government’s claim that the High Court’s order is wrong only to remove “domestic obstacles” for client restitution.

“The government should at least require the release of Abrego Garcia to at least give any meaning to the Supreme Court order,” the filing states. “The government hasn’t done so far.”
