Mexican National Charged in Alabama Shooting Illegally in U.S., Says ICE

MONTGOMERY, Alabama — Police have arrested Alberto Martinez Fidel in connection with a shooting that occurred Sunday morning in Montgomery, Alabama. Martinez is accused of shooting another city resident in the back and buttocks, severely wounding him.

Police have provided little information about the victim, but court documents state Martinez is suspected of shooting the victim at close range with a handgun. Following his arrest, Martinez was booked into the Montgomery County Jail and charged with first-degree assault.

The court set Martinez’s bail at $30,000. report According to WSFA 12, a spokesperson for the U.S. Immigration and Customs Enforcement (ICE) reported that Martinez is a Mexican national who is in the United States illegally.

Following an inquiry to ICE, an ICE spokesperson provided the following statement to Breitbart Texas: “The U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations Unit filed a detention warrant for Alberto Martinez Fidel, age 46, an undocumented Mexican national who was arrested by Montgomery Police Department on August 5, 2024. ICE does not have any prior immigration information on this individual.”

The ICE Enforcement and Removal Office (ERO) applies for immigration detention orders for immigrants who have been arrested for criminal activity and are being detained by state or local law enforcement. Immigration detention orders request that ICE notify state or local law enforcement as soon as possible before an immigrant who is subject to deportation is released from custody.

A detention order requests state or local law enforcement to detain the alien for a period not to exceed 48 hours beyond the time the individual is scheduled to be released, allowing ERO to assume custody for removal purposes under federal law. Each detention order is accompanied by a Congressionally authorized arrest warrant.

The lack of an immigration history suggests that Martinez-Fidel entered the US illegally between ports of entry and made it to US soil without encountering a Border Patrol agent. If correct, he could be one of the more than 800,000 fugitives reported by the US Border Patrol in the past three years.
