‘Misled The Judge’: Gregg Jarrett Says Jack Smith Got Caught ‘Manipulating Evidence’ Against Trump

Fox News legal analyst Greg Jarrett said Monday that special counsel Jack Smith “misled” a judge about preserving evidence in a case related to the classified documents case against former President Donald Trump. Ta.

Smith admitted Friday. filing Evidence was presented by federal investigators before Trump-appointed U.S. District Judge Eileen Cannon after the attack on the former president’s Mar-a-Lago, Florida mansion on Aug. 8, 2022. The complaint alleges that it was not stored properly. Jarrett said it was “no small matter” that the special counsel acknowledged that the evidence was seized and not preserved and that the court was misled. “Prosecutors have an obligation to preserve the evidence exactly as it was seized,” Jarrett told Fox Business host Larry Kudlow. “Special Counsel Jack Smith admitted in court that he falsified and manipulated evidence against Trump. Digital scans of documents do not match physical order in seized boxes.”

“And Smith got caught,” Jarrett continued. “His excuse is, well, Your Honor, it’s a complex case and there’s a lot of documentation, but that’s not an excuse. This is evidence tampering. This is destroying exculpatory evidence, and what’s worse. Smith was forced to admit it even though he lied in court and said in a footnote that he had “misled the judge.” This is no small problem, Larry. ”

Smith announced the indictment against Mar-a-Lago maintenance worker Carlos de Oliveira after the special counsel initially secured a 37-count indictment against Trump and aide Walt Nauta in June 2023. Published an indictment to be replaced on July 27, 2023, including:

“There are several boxes where the order of the items within the box is not the same as the associated scan,” Smith’s team’s submission said. “There are several possible explanations, including the above case where the box was accessed and the size and shape of certain items within the box may have led to the items being moved. For example, the box may contain index cards, books, etc. , they contain items that are smaller than standard paper, such as stationery, and can easily shift when carrying the box, especially since many of the boxes are not full.

Smith’s team also acknowledged in a footnote that the statement was “inconsistent” with what Cannon said in earlier arguments. Prosecutors also acknowledged that after the FBI ran out of covers, it installed blank sheets and covers with notes about the document’s sensitivity level.

“Investigative teams used classified cover sheets for that purpose until there were too many classified documents and the FBI ran out, but from that point on the team used handwritten cover sheets to indicate the sensitivity level of the documents they seized. “We started using blank sheets with notes,” Smith’s team said in the filing. “The investigation team seized boxes that were found to contain documents with classification marks and presidential records.”

“The chronology of the documents is critical to Mr. Trump’s defense,” Jarrett said. “The staffers put them in the box exactly as they received them from the GSA, which sent them to Mar-a-Lago.” “We also know that the National Archives is coordinating with the Joe Biden White House and the Biden Justice Department on how to bring criminal charges against Donald Trump. It could be argued that.”
