The defense argued that there should have been “indisputable evidence” of the circumstances that led to Gregg's actions, leading to a mistrial.

“Carly's mental illness, loving relationship with her mother and stepfather, lack of past criminal charges, lack of past violence, good school performance, mother's family support, community support, Carly's loving relationship with her mother and stepfather, The incontrovertible evidence at trial regarding the victim's testimony that she was sane and not aware of the crime at the time of the crime, and the state's admission that there was no motive for the crime, has no effect on the verdict or sentencing in this case. That is not substantiated,” the defense attorney said.
