Riley Grunden is suing Missouri Mountain View Birchtree R-III School District with suspension received for posting a photo of Dr. Pepper Cans, placed in the form of a rifle.
Reason Magazine It’s attracting attention Granden’s son, WG, took a photo of the can at home on September 14, 2025 and posted it on social media. “This post comes with a trending audio file entitled “AK47.” This includes: “This is the famous AK47, which is manufactured by over 50 million people in 10 countries. The AK47 is the most popular attack rifle in the world.”
The school’s principal called Riley Grunden on September 15, 2025, and note that parents complained about the photos and WGs will be searched when they arrive at school the following day.
The search did not create anything dangerous, but school officials could be considered a “terrorist threat” because they believed the social media posts “sinned fear for other students.” The WG was then suspended for three days.
Fox News It has been reported The Goldwater Institute filed a lawsuit over the suspension, claiming that WG’s post was misinterpreted “to justify punishing creative expression protected by the First Amendment.”
The Goldwater Institute pointed out the Supreme Court’s Mahanoy Area School Districtv. BL (2021) Note that if the speech arises from campus, the school’s ability to control speech is very limited.
