New Jersey Governor Signs Bill Banning Masks for Law Enforcement

This week, New Jersey’s Democratic Governor, Mikie Sherrill, enacted a law that prohibits law enforcement, including Immigration and Customs Enforcement (ICE) officers, from wearing masks. This move aims to make these officers more visible and, perhaps, less prone to targeted harassment.

Reports indicate that on March 25, she signed SCS S3114 and 3216/A1743. In her announcement, she emphasized the need for law enforcement officers to reveal their facial identities during public interactions and to adequately identify themselves before making any arrests or detentions.

“These bills highlight our commitment to the Constitution and the rule of law here in New Jersey,” Sherrill noted in a statement concerning the laws she had just signed. She added that her primary focus as governor is to ensure public safety. Additionally, she criticized former President Donald Trump, asserting that ICE agents are “untrained” and “unaccountable.”

Sherrill pointed out, “As we have seen across the country, Trump’s masked ICE agents pose risks to the community.” She argued that New Jersey’s new legislation is a step to enhance protections by banning ICE’s use of masks, aiming to safeguard residents’ privacy and curb federal overreach.

This issue plays a pivotal role in ongoing discussions about government funding, with Democrats advocating for reforms targeting ICE’s practices, particularly regarding their mask usage.

Senator Tom Cotton (R-Ark.) responded to these developments by asserting, “Senate Democrats want to ban ICE officers from wearing masks so militant groups can target police and threaten their families.” His comments came on the 40th day of a Senate debate concerning funding for the Department of Homeland Security (DHS), which lasted into its 41st day on Thursday.

A spokesperson for DHS recently commented on the New Jersey law, describing it as “despicable” and an evident attempt to jeopardize federal officers. They also asserted that they would not comply with what they consider “unconstitutional prohibitions,” explaining that the Supremacy Clause makes it clear that state leaders cannot dictate terms for federal law enforcement.

The spokesperson emphasized the significance of wearing masks for ICE officers, citing alarming statistics: assaults on these officers had risen by over 1,300 percent, vehicle attacks surged by more than 3,300 percent, and death threats escalated by 8,000 percent. “ICE officers use masks primarily for their protection,” the spokesperson noted, “and the dangers they face are very real.”
