East Palestine Residents Sue Norfolk Southern Over Derailment

Eight residents from East Palestine, Ohio, have initiated a lawsuit against Norfolk Southern Railroad Company, claiming that the harm they suffered after the February 3, 2023, derailment was “greater” than initially acknowledged.

This legal action stems from the railroad’s decision to divert and incinerate several tankers of polyvinyl chloride following the incident, as noted in reports from Friday.

When the train carrying hazardous chemicals derailed, it prompted mass evacuations in the surrounding area, leading to significant community disruption.

Three days post-derailment, authorities conducted a “controlled release” of the toxic materials due to concerns about a potential “devastating explosion,” necessitating further evacuations as rail cars were burned for hours.

A lawsuit lodged in the US District Court for the Southern District of Illinois has now been transferred to a court in Northeast Ohio. The suit claims that Norfolk Southern “escalated the harm from the derailment” and caused “extensive contamination.”

Those filing the lawsuit, who opted out of a $600 million class action settlement the previous year, argue that the railroad failed to explore safer controlled burn alternatives and prioritized getting back on track quickly without regard for the local community’s wellbeing.

A neighbor of mine expressed how shaken they were by the derailment’s impact. In a discussion shortly after the incident, a local resident requested prayers, conveying the community’s anxiety about the hazardous materials and looming explosion risks.

Pete Buttigieg, the transportation secretary under former President Joe Biden, voiced his concerns regarding the derailment’s repercussions. Reports surfaced earlier in 2024 critiquing the Biden administration for its response to the crisis ongoing over a year after the derailment.

On the other hand, JD Vance, the former Vice President’s ally, recently revisited East Palestine to mark the second anniversary of the toxic incident. He expressed a desire to reaffirm the community’s importance, noting that he relayed this visit to the President.

“President Trump aims to assure the people of East Palestine that they will not be forgotten,” Vance remarked.
