READ: Trump’s appeal of Colorado ballot ban to Supreme Court

Former President Trump on Wednesday asked the Supreme Court to overturn a Colorado court's landmark ruling that disqualified him from the state's 2024 Republican primary election based on the 14th Amendment's anti-insurrection clause.

Trump's petition asks the Supreme Court to take up the case and agree to immediately overturn the Colorado ruling on summary judgment without oral arguments. Other parties to the case have previously agreed that the justices should hear the case on an expedited schedule, so a decision could come before most states' primaries. , did not indicate that the high court would abandon the step of holding oral arguments.

The appeal is likely to begin an unusual battle before the nation's highest court, which has never decided on Section 3 of the 14th Amendment. This clause, added after the Civil War, prohibits anyone from holding federal office if they take an oath to “support” the Constitution but “participate in rebellion” against it.
