Call for Action on ATF Gun Regulations

Rep. Andrew Clyde (R) is spearheading a group of House Republicans urging President Donald Trump to appoint an attorney general who will “immediately” revoke gun regulations established during the Biden administration.

On April 21, 2026, Clyde and 32 other members of Congress sent a letter, asking Trump to select someone who will “immediately halt enforcement of Biden-era gun laws and ensure relief that is permanent, not temporary.”

The letter highlights three specific regulations that should be addressed by the new attorney general:

  • The enforcement of Biden’s pistol stabilizer rule against certain individuals, despite a Second Amendment-supported injunction regarding firearm possession.
  • Concerns regarding the ‘ghost gun’ regulation, which survived Supreme Court scrutiny due to the Justice Department’s failure to invalidate the case.
  • Biden’s involvement in the rules for universal background checks, pointing to adjustments made rather than a complete repeal.

Clyde and his colleagues emphasized the need for the next attorney general to provide guidance that prevents Justice Department lawyers from defending laws deemed unconstitutional.

The Department of Justice should not be tasked with defending clearly unconstitutional firearm regulations, particularly following the Supreme Court’s significant ruling in New York State Rifle & Pistol Assn. v. Bruen. The next Attorney General should issue directives for Justice Department lawyers to assess all firearms cases through Bruen’s historical standards and reject defenses that falter under that examination.

Additionally, Clyde and others want Trump to select an AG who can reform the ATF. Their proposed reforms include:

  • Removing bureaucrats who misappropriated firearms from the ATF.
  • Opposing any initiatives for a federal firearms registry in any format.
  • Halting ATF’s release of sensitive firearms tracking data that violates the Tierhardt Act.
  • Shutting down the illegal searchable gun registry known as the Out Business Records Imaging System (OBRIS).
  • Reducing the processing time for NFA applications.

Clyde also pointed out the robust support Trump received from gun owners during the November 2024 election, suggesting that he should reciprocate their loyalty: “Mr. President, America’s gun owners are some of your most loyal and passionate voters. They voted for you at the polls, and they deserve their constitutional rights respected in return.”

“This plan doesn’t call for new laws; it just needs leadership, determination, and a Department of Justice that truly addresses the agenda rather than shielding its own inaction.”
