Scott Peterson’s Case Could Be Revisited with New Evidence
LAS VEGAS — Scott Peterson’s attorney recently suggested that newly acquired evidence might prompt a court to reassess his murder conviction, just as a documentary about the case is set to premiere this summer.
This development follows a ruling from a San Mateo County Superior Court judge on April 27, which turned down a previous attempt to overturn his conviction. The Los Angeles Innocence Project, representing Peterson, plans to appeal that decision.
In a high-profile case, Peterson was convicted in 2004 for murdering his wife, Lacey, and their unborn child around December 24, 2002, in Modesto, California.
Mark Geragos, Peterson’s longstanding defense attorney, expressed to Fox News Digital at Crimecon in Las Vegas that he hasn’t seen anything that would substantiate a conviction against Peterson.
Geragos pointed to a van discovered burned out near Peterson’s residence post-robbery, arguing that this piece of evidence was initially overlooked by prosecutors. “This van was abandoned close to the house, and there’s a wealth of evidence in it that should have been scrutinized,” he explained. Some of this evidence remains available for examination, while others have yet to be looked into thoroughly.
In their past court documents, Peterson’s defense detailed that on the day Lacey went missing, she had confronted robbers attempting to break into a home across the street. Geragos contended that this would exonerate Peterson, as he was reportedly out fishing at the time of her disappearance.
Despite their efforts, Geragos mentioned that a list of items for potential DNA re-testing submitted by the Innocence Project was rejected by the court.
“Honestly, if you’re a prosecutor, why wouldn’t you want to clear up any mistakes? The only reason could be a doubt in the case against the accused,” Geragos commented further, hinting at ongoing developments in the case.
Ninette Tousby, a former LAPD detective and current part of Peterson’s defense team, emphasized that numerous witnesses had reached out to the Modesto Police Department claiming they hadn’t seen Laci on the morning of December 24, but their statements weren’t sufficiently investigated.
She highlighted, “If even just a couple of those witnesses had been properly vetted, they might have cleared Scott as a suspect right away. It’s a clear oversight by the Modesto PD.”
A&E is set to air a two-part documentary titled “Scott Peterson: New Evidence” on July 16 and 17, featuring witness accounts and insights from Geragos and others involved.
