Senate Republicans oppose using taxpayer money for Tish James’ fund that might cover her legal expenses.

The state Senate Republicans are challenging the $10 million “slush fund” that was quietly included in the Empire budget, which could be used to fund Attorney General Letitia James’ legal costs as she deals with a criminal investigation.

The GOP has urged state director Tom DiNapoli to reject this expenditure, referencing remarks from Democrats who focused on indicting former President Trump without directly mentioning James.

“Using taxpayer money in this manner represents a serious misuse of public funds,” stated a letter endorsed by GOP Senate minority leader Robert O’Haute and 21 other Republicans.

“It undermines public trust in the government, sending a concerning message that elected officials and state employees are entitled to public funds for legal defense, even in issues unrelated to public liability,” the letter continued.

“As has been said before, no one is above the law,” the letter remarked, echoing a phrase often used by the Attorney General, who is currently investigating cases involving Trump’s Department of Justice.

Governor Kathy Hochul and the Democratic majority in the state legislature have permitted government officials to pay “reasonable attorneys’ fees and costs” if they are “under federal oversight” starting January 1, 2025.

A spokesperson for DiNapoli confirmed receipt of the letter but did not provide further comments.
