The Supreme Court of the United States (SCOTUS) has agreed to hear Smith & Wesson's appeal to end Mexico's $10 billion lawsuit against the famous American firearms manufacturer.
On August 4, 2021, Breitbart News reported that the Mexican government has accused six U.S. firearms manufacturers and the Boston area of reported that they are suing one wholesaler.
The Mexican government's lawsuit begins with a human trafficking allegation, naming six manufacturers and wholesalers:
Plaintiff Estados Unidos Mexicanos (the “Government”), a sovereign nation, is committed to the harm caused by Defendants by actively facilitating the illegal trafficking of guns to drug cartels and other criminals within Mexico. We filed this lawsuit to put an end to the extensive damage caused. Almost all guns recovered at crime scenes in Mexico (70% to 90% of them) are trafficked from the United States. The companies include six manufacturers (Smith & Wesson, Beretta, Century Arms, Colt, Glock, and Ruger). The other manufacturer defendant is Barrett, whose .50 caliber sniper rifles are prized weapons of war by drug cartels. The remaining defendant, Interstate Arms, is a Boston-area wholesaler, and all but one of the defendant manufacturers sell guns for resale to gun dealers throughout the United States. .
The number of companies indicted ultimately reached a total of eight.
On Wednesday, August 7, 2024, U.S. District Judge Dennis Saylor dismissed most of the lawsuit. However, the BBC reported “Smith & Wesson Brands and Whitmer Public Safety Group remain defendants following the judge's ruling.”
Friday, October 4, 2024, Reuters noticed SCOTUS has filed a lawsuit seeking to dismiss a Mexican lawsuit accusing U.S. firearms manufacturer Smith & Wesson and firearms wholesaler Interstate Arms of aiding and abetting the illegal trafficking of firearms to Mexican drug cartels. We will investigate the case.''
