Supreme Court to Take Up Trump’s Appeal of Colorado Ballot Removal

The Supreme Court is scheduled to hear arguments in former President Donald Trump's appeal of the Colorado Supreme Court's decision to remove him from the ballot, but the monumental case , could impact similar voting access issues in states across the country that could decide the presidential election.

In a 4-3 opinion in December, the Colorado Supreme Court ruled that the 14th Amendment's “insurrection clause” bars Trump from voting in the 2024 presidential election. I put it down. The ruling partially overturned a lower court's ruling that Trump was not an official. Therefore, he says, he cannot use the amendment to disqualify him from participating in Colorado's primary elections.

The court found that “clear and convincing evidence” that Trump It unilaterally determined that the evidence proves that the president was involved in the insurrection. The U.S. Senate acquitted him of charges of involvement in the insurrection, but he continues to deny his wrongdoing.

Even though President Trump was acquitted by the House of Representatives charges in the Senate, there was no court proceeding to support his legal claims, and the court cited a Jan. 6 U.S. House Select Committee.

The Colorado lawsuit is one of many filed in states across the country citing the “insurrection clause” as a justification for removing Trump from the ballot. Trump has received favorable results in several states (including Colorado before the Supreme Court partially overturned the ruling), but Maine's secretary of state also removed him from the ballot.

The Supreme Court has never issued a final ruling on the meaning of Section 3 of the Fourteenth Amendment. The court's decision on the Colorado case could also become final in Maine and other states.
