Supreme Court will hear challenge to Colorado ban on ‘conversion therapy’ for non-straight youth

State Lawa revision of Colorado's Mental Health Practice Act prohibits psychiatrists and mental health care providers from encouraging individuals to rethink their sexual preferences or “change their behavior and gender expressions.”

Under the law, mental health professionals who have not declared their delusional or homosexual tendencies could face disciplinary action, lose their license, or receive large fines. But likewise, the law does not prohibit gender ideologues from encouraging children confused during therapy sessions to actually be members of the opposite sex or accept sexual change.

Caylee Chile, a licensed counselor and a trauma-specialist Christian practice where minors are Christians with eating disorders and gender discomfort, filed a federal lawsuit in September 2022, alleging that the censorship law violated the free speech and freedom movement clauses of the first amendments that were applied to her.

“Their relationship between faith and God replaces romantic charm.”

Court documents Chile has long been working with “adults seeking Christian counseling and minors internally motivated to seek counseling.” Her clients found her through referrals from churches and word of mouth. Their “relationship between their faith and God replaces romantic charm.” And that “God decides their identity according to what is revealed in the Bible, not the charm or perception that determines their identity.”

Chile showed that if they were not seeking change, they would not try to help minors change their sexual preferences or identity. Rather, “She tries to support her clients with their stated desires and purposes in counseling, including clients who try to reduce or eliminate unnecessary sexual attraction, change sexual behavior, and develop experiences of physical and harmony.”

“It goes beyond controversy for these laws to limit speech.”

Although she has not yet received complaints, the plaintiffs alleged that Colorado law has cooled down her speech and had a negative effect on both her counseling and her ability to help minors.

Chile's favor ruling would threaten similar bans in 27 states against helping minors overcome their confusion.
