On March 21, a horde of migrants from Venezuela, mostly military-age men, stormed the U.S. border, assaulting the Texas National Guard and destroying U.S. property in El Paso. Although federal immigration officials were reportedly uncooperative, Texas was able to arrest several rioters.
But rather than hold the illegal aliens accountable, Judge Humberto Acosta ordered them to be released to the United States “on their own recognizance.”

Blaze News previously reported that an angry mob of foreigners broke through the razor wire barrier at Gate 36 and eventually overpowered a group of Texas National Guard soldiers who chose not to open fire.

The incident reportedly began when the Texas National Guard allegedly separated some women and children in an attempt to form small groups for processing. Hundreds of foreigners used this as an excuse to riot and overpower the security guards.

“These people were willing to attack the military,” the source said. “They were willing to attack law enforcement. They have a complete disregard for our laws.”
After the incident, Mr. Abbott announced Texas announced the deployment of an additional 700 members of the Texas National Guard, along with 200 members of the new Texas Tactical Border Force.

One of the migrants, 21-year-old Honduran Junior Evaristo Benitez, was taken to the El Paso County Jail. Benitez is charged with assault on a public servant, among other charges, and is accused of “deliberately and maliciously” stomping on the knee of a security guard, according to court documents.

Judge Acosta criticized the El Paso District Attorney’s Office for suggesting during Sunday’s online videoconference bond hearing that prosecutors were not prepared to proceed with detention hearings for all of the riot suspects.

“So if the prosecutor’s office tells me they’re not ready to release, what we’re going to do is release all of these individuals on their own recognizance.” Acosta said.
Acosta did not say how many illegal aliens had been arrested on charges of “participating in a riot” and how many he would ultimately release, but said Sunday that “several hundred arrests” will be given 48 hours. He said he is entitled to an individual detention hearing within the next two days.
The judge denied Assistant District Attorney Ashley Martinez’s request to continue the case at a later date, the Times reported.
Separate hearings are scheduled for Monday for other people charged in connection with the riot.
In addition to calling for the release of the rioters, Acosta reportedly also approved the release of two other illegal immigrants who were imprisoned on suspicion of destroying the border fence.
Local newspapers emphasized that those arrested will remain incarcerated if U.S. Immigration and Customs Enforcement prevents their release. ICE previously told the New York Post that it was detaining more than 200 illegal aliens.
