Former Rep. Matt Gaetz (R-Florida) resigned from the House last week. That's the final one. Under House precedent, once you resign, that's it. Therefore, Gates cannot rescind his resignation from last week. He announced his resignation “effective immediately.”
As previously reported, Gaetz may serve as a member of the new Congress. Mr. Gaetz has been formally re-elected to his seat in the new Congress, which is scheduled to open on January 3rd. In a letter to the Clerk of the House, Gaetz declared, “I do not intend to take the oath of office in the House of Representatives.” 119th Congress pursues attorney general position in Trump administration. ”

But Mr. Fox is said to have to inform the House clerk that Mr. Gaetz does indeed intend to serve in the new Congress — if he chooses to do so. Gates has not disclosed his future plans. That part of Gaetz's letter is not binding.
Technically, the House Ethics Committee has until the end of the session on January 3 at 11:59:59 a.m. ET to conclude its investigation into Gaetz. But there is precedent for the House Ethics Committee voting to take over the investigation. Make Congress different. So it's not unprecedented that this was agreed upon.

The Committee still wishes to complete its current work. But if Gaetz does not plan to serve in the new Congress and withdraws his nomination for attorney general, the importance of releasing the former lawmaker's report is likely to diminish. Yes, the report may contain damning information, but the House typically does not release reports on former members, despite precedent. Moreover, the Senate Judiciary Committee has no interest in the report now that Gates is not a nominee for attorney general.

Additionally, if Gaetz is elected to the House, the numbers of Rep. Elise Stefanik (R-N.Y.) and Rep. Michael Walz (R-Minn.) would be an advantage for Republicans. – and perhaps more – to resign to join the Trump administration.
