Former President Trump’s White House lawyer Ty Cobb on Wednesday went after Judge Eileen Cannon for indefinitely delaying former President Trump’s criminally classified documents case on procedural grounds, accusing her of being “incompetent.” did.
“I don’t think this lawsuit will move at all,” Cobb said in an interview with CNN’s Erin Burnett. “And I think the fact that she’s scheduling hearings, multiple hearings, her one or her two motions at a time, is compelling evidence of that. “Frankly, this case should have gone to trial yesterday or two days ago when the original trial date was set,” he continued. “This case could have easily gone to trial. It’s just that her incompetence and bias prevented it from happening.”
After leaving the White House, President Trump is accused of mishandling classified documents and obstructing investigations to recover them. Cannon, a Trump appointee, has repeatedly delayed the case, and it is unlikely that it will go to trial before the upcoming election.
Cannon’s delays have drawn widespread criticism from Democrats, who see his actions as an attempt to defend the former president, and the Justice Department is likely to drop the case if he is re-elected in November.
Sen. Chris Coons (D-Delaware) said earlier this month that “trials postponed are often justice denied.” He is “very frustrated that the judge is managing this case in a way that makes it very unlikely that it will be resolved in a timely manner.”
After Cannon quashed key trial deadlines earlier this month, effectively postponing the case indefinitely, Judge Cobb said the judge “does not intend to send this case to trial.”
Judges have previously rejected all attempts by the defense to dismiss the case, but it is taking months to rule on each motion, given the case’s significance for the 2024 election. This is a particularly slow time frame.
