Maggie Haberman on Trump Administration’s Legal Moves

Journalist Maggie Haberman commented on the Trump administration’s proposal regarding habeas corpus, suggesting it aimed to disrupt the courts and instill fear in undocumented immigrants.

“It seems at least somewhat alarming. Essentially, it serves as a way to intimidate the judiciary, and Trump along with Stephen Miller have consistently targeted judges in their rhetoric,” she remarked.

“This might also frighten immigrants, potentially pushing them to leave,” she noted.

The constitutional principle mandates that anyone detained must be brought before a judge, securing their release unless there’s a legal justification for their confinement.

The White House defended its extensive deportation efforts, claiming they were backed by 18th-century laws concerning aliens and enemy combatants, which allow for swift removal of immigrants during invasions.

“The Constitution is explicit; it is the supreme law of the land—the privilege of habeas corpus can be suspended during an invasion,” stated White House Deputy Chief of Staff Stephen Miller on Friday.

“We’re actively considering that option. Ultimately, it hinges on whether the courts execute their responsibilities correctly,” he added.

Haberman, along with numerous judges, indicated that the Trump administration misinterpreted legal frameworks and exceeded its jurisdiction.

“Many judges, including those Trump appointed in his first term, have stated their interpretations have been incorrect, indicating that the administration has overreached concerning laws on alien enemies,” she concluded.
