Three Senate Democrats crossed the aisle Wednesday to vote against the Biden administration’s proposed electric vehicle (EV) plan.
Democratic Sens. Joe Manchin of West Virginia, Sherrod Brown of Ohio and Jon Tester of Montana, along with their Republican colleagues. Disable It’s a Federal Highway Administration (FHWA) rule that critics characterize as an effort to reduce the number of gas-powered cars on America’s roads. Arizona Sen. Kyrsten Sinema, an independent who typically caucuses with Democrats, also voted in favor of the nullification resolution, making the final vote 53-47.

Two federal judges have also ruled against the regulation in recent weeks.

Mr. Manchin, along with his Republican colleagues, helped introduce the override resolution, but Mr. Brown and Mr. Tester each face re-election races in the 2024 cycle.
However, the White House said President Joe Biden would veto the bill if it reaches his desk. according to Go to Politico.
Republican North Dakota Sen. Kevin Cramer, who introduced the bill, said on the Senate floor Wednesday that “unelected bureaucrats are claiming powers they don’t have, and are trying to confuse federal mediocrity over state excellence.” There is nothing more frustrating for the government than being forced to do so.” “The Senate has rejected the Biden administration’s clearly illegal rule that would require state departments of transportation to measure tailpipe CO2 emissions and then set reduction targets for vehicles on highways in targeted states. I will take up my bipartisan resolution to overturn it.”
Kramer has consistently been a vocal critic of the regulations, saying they are “fundamentally unworkable” in rural states like the one he represents. He had previously characteristic The regulation is a thinly veiled effort by the federal government to promote EVs.
Other federal agencies, such as the Environmental Protection Agency (EPA) and the National Highway Safety and Transportation Administration (NHTSA), have also pushed their own rules in recent months that would effectively mandate a significant increase in EV production over the next few years.
The White House and FHWA did not immediately respond to requests for comment.
