Teen Girls Sue Elon Musk’s AI Company Over Image Generator
Three teenage girls have initiated a class action lawsuit against Elon Musk’s AI firm, xAI, claiming that its Grok image generator was misused to create and share child sexual abuse material using their images.
The lawsuit, filed in California where xAI operates, marks the first legal case brought forth by a minor amid growing concerns regarding Grok’s production of non-consensual nude images earlier this year. Two of the plaintiffs are minors from Tennessee, asserting that their photographs were used to fabricate AI-generated sexual content without their consent.
According to the complaint, the girls found out that nude images of them, altered by AI, had been uploaded to a Discord server and circulated on various online platforms. This unsettling discovery happened in December when one plaintiff, referred to as Jane Doe 1, received a warning from an anonymous Instagram user. The message informed her that someone within her social circle had shared deepfake videos and images on Discord that depicted her and other high school girls in compromising positions.
The complaint identifies three AI-manipulated images that seemingly originate from photos of Jane Doe 1 taken when she was underage, including one from a homecoming event. It specifies that these images exposed her entire body, including her genitals, and a video depicted her undressing completely.
Authorities were notified about the images, leading to the arrest of a suspect later that month. Investigators reportedly discovered child sexual abuse material on the suspect’s phone, allegedly generated using xAI’s technology. They also found that these images had been exchanged on the Telegram messaging app for other child pornography.
In February, two other plaintiffs realized similar AI-generated content of them was also circulating online. The lawsuit seeks reparations from xAI for both reputational damage and mental health issues stemming from the images’ creation and distribution.
“xAI profited from the sexual exploitation of real individuals, including children, fully aware of the risks associated with releasing such a harmful product,” said Vanessa Baer Jones, the attorney representing the plaintiffs. “It was devastating to witness my daughter suffer a panic attack upon learning that these images were created and spread with no way to take them back,” remarked the mother of one plaintiff via her spokesperson.
The lawsuit contends that child sexual abuse material was generated using third-party applications that utilized Grok’s AI technology. Although the images weren’t produced directly on xAI’s site or Grok app, the suit argues that this operation still depended on xAI’s servers, which benefit financially from licensing their technology to these applications. Plaintiffs’ attorneys accuse xAI of diminishing its liability through its licensing arrangements and lack of oversight.
