The company is seeking to block the new law that would force it to sell or ban the app, arguing that it violates the First Amendment’s free speech rights.
The petition states that the new law “will force a shutdown of TikTok by January 19, 2025, silencing the 170 million Americans who use TikTok to communicate in ways they can’t do anywhere else.” “It will become.”
He also said that a sale within 270 days would be “absolutely impossible.”
According to the petition, the Chinese government has “made clear that it will not allow the sale of its recommendation engine, which is key to TikTok’s success in the United States.”
“For the first time in history, Congress has made a single designated speech platform subject to a permanent, nationwide ban, barring all Americans from participating in a unique online community with more than 1 billion participants worldwide. “We have enacted a law to do so,” the company said. said in the petition.
The lawsuit, filed in a federal appeals court in Washington, D.C., seeks to block the law, which President Joe Biden signed in less than two weeks.
China’s ownership of TikTok has raised concerns among national security lawmakers. Biden could decide to extend the January deadline by three months.
TikTok says it has never been asked by an American to provide user data to the Chinese government and would not respond if asked. ByteDance said it has no plans to sell its U.S. operations.
The court overturned an earlier attempt to impose restrictions on TikTok in the United States.
If ByteDance does not sell TikTok, the law would prohibit app stores and web hosting services from making the service available to Americans.
