President Donald Trump's administration has called on the U.S. Supreme Court (SCOTUS) to allow members of foreign gangs illegal under the Foreign Enemy Act to be deported.
As reported by Breitbart News, Trump has begun calling for alien enemy laws and deporting hundreds of illegal alien gang members with trendy lagua and MS-13 gangs.
Two deportations are underway, heading to the mega prison in El Salvador, where two left-wing groups sued, and Justice James Boasburg issued Temporary restraint orders, stopping Trump from using alien enemies to deport more gang members.
This week, the Court of Appeals upheld Boasberg's ability to block Trump from deporting him under the alien enemy law.
In a filing with Scotus on Friday, the Trump administration asks the court to allow immediate administrative stay while considering applications to vacate Boasburg's order completely.
“At the very least, the representative general, would respectfully request that this court grant administrative stay while considering the submission of the government,” he said. I'm writing In that submission:
The flawed orders of the district court threaten the sensitive government negotiations with foreign forces. And as long as the order is in force, the United States cannot rely on the declaration, even if it receives indication that a particular TDA member is trying to obtain destabilizing or invasive behavior. The court's order could also be extended for another two weeks based on respondents' recent submissions to the district court. In these circumstances, administrative stays are guaranteed while this court evaluates the government's eligibility for Vacature. [Emphasis added]
This court must override the district court order. Furthermore, the acting The Attorney General requests with respect for immediate administrative stays of a district court order where court consideration for this application is pending. [Emphasis added]
The Trump administration has already told Boasberg it will not provide additional details about deportation flights to El Salvador, evoking the nation's secret privileges.
