The Trump administration has accused President Joe Biden’s Justice Department of collaborating with pro-abortion groups to create private dossiers on Christian pro-life advocates, using personal information and images of their children. This, they claim, is part of a larger effort by the Biden administration to prosecute these individuals under the FACE Act.
A report from the Justice Department, titled “2026 Report by the Task Force to Eradicate Anti-Christian Bias,” spans over 200 pages and outlines numerous incidents and policies from Biden’s tenure, asserting that his administration actively sought the prosecution of Christians. The report argues that Biden’s policies often conflicted with Christian beliefs, particularly regarding issues like abortion and gender ideology, ultimately leading to repercussions for those who uphold their convictions.
It also indicates that former Attorney General Merrick Garland misused the FACE Act against pro-life activists, particularly through the reinstatement of the National Task Force on Violence Against Reproductive Health Care Providers.
While the FACE Act prohibits obstructing access to reproductive health centers—such as pregnancy resource centers and abortion clinics—the report contends that Biden’s law enforcement agencies worked closely with abortion clinics to pursue legal action against pro-life activists.
Moreover, the task force intended to investigate the activities of those who oppose pro-choice views, which led to warnings from the FBI regarding pro-choice groups tracking pro-life activists participating in lawful protests.
The report claims that the task force surveilled pro-life activists in contact with these groups, alleging they violated the FACE Act by protesting outside clinics. It was also revealed that abortion groups provided the Justice Department with detailed reports on pro-life activists, including their personal details.
In 2021, pro-choice advocates shared a comprehensive memo with the task force and FBI that included detailed information about an anti-choice conference, ultimately resulting in indictments for several individuals targeted by the Department of Justice.
The task force’s actions extended to monitoring alleged FACE Act violations for years, with the report indicating a pattern of complaints from abortion groups about specific female pro-life activists.
Some advocates are voicing their concerns; Penny Nance, CEO of Concerned Women for America, described the Biden administration’s actions as “illegal weaponization” against pro-life individuals, calling the situation unconscionable. Nance emphasized that no American should face politically motivated attacks for expressing their beliefs.
In January 2025, President Trump issued pardons for 23 pro-life activists who had been charged under the FACE Act. This report follows an 800-page document from the Justice Department that unveiled thousands of internal records suggesting improper use of the SAVE Act against conservative activists.
Acting Attorney General Todd Blanche reiterated, “Our department will not tolerate a two-tiered justice system,” asserting a commitment to preventing the kind of selective prosecution that occurred previously under the Biden administration.
Individuals close to Biden have not offered comments regarding the report. Meanwhile, an inquiry has been made to the National Abortion Federation for their perspective.
