Trump targets activists’ frivolous lawsuits with financial penalties

President Donald Trump signed the memo on Thursday, demanding that federal judges impose financial penalties on “activist groups” who file “funny” lawsuits against the government.

administration Factsheet On the memo, “President Donald J. Trump guarantees the enforcement of Rule 65(c) of federal civil lawsuits. “We need financial guarantees from the plaintiffs requesting a place where the government can show financial harm from the remedies requested.”

“Activist groups are filing futile lawsuits for fundraising and political interests.”

“This guarantees compensation for potential costs or losses if the court later finds it has incorrectly issued an injunction.”

Trump demanded that “federal courts require post-security security equivalent to the potential federal costs and damages from an interim injunction or temporary restraining order that was issued incorrectly.”

The memo is intended to stop judicial overreach and frivolous complaints.

The fact sheet said the injunction “will cost taxpayers millions or billions of dollars.”

The Trump administration has accused “activists” and “unelected district judges” of “becoming a radical injunction beyond their authority.”

“Activist groups have filed meaningless lawsuits for fundraising and political interests, and have no impact when they lose while taxpayers are carrying costs and delays,” the fact sheet reads. “The Department of Justice is forced to divert resources from public safety to combat these frivolous incidents, weakening effective governance.”

Trump's memo does not require federal judges to impose financial guarantees.

“The enforcement of Rule 65(c) will block such a case by holding the plaintiff liable for costs and damages if the plaintiff is protected from the integrity of the taxpayer's funds and judicial integrity,” he added.

Less than two months later, the Trump administration has already faced more than 100 lawsuits from legal groups, labor unions, and other plaintiffs who challenge some of the president's enforcement actions. Over 20 cases challenge the actions taken by government efficiency, and another 20 are related to changes in federal funding, employment and institutional structure. ABC News It has been reported.

Washington-based lawyer Mark Zaid filed a lawsuit against the Trump administration last month. CNN The president's memo is “a very bold move that violates norms.”

“This will be open to the court,” Zaid said. He said the lawsuit “can be incredibly strong for the Trump administration.”

He argued that the administration “will exploit existing loopholes and opportunities to make it difficult for anyone to challenge it.”

“In this case, they identified something that actually appears to be a utility to rely on that face,” Zaid added.
