The Veterans Affairs Bureau (VA) announced a reversal on its earlier policy regarding abortion services for veterans, returning to a standard in place before September 2022. This change was made public in a memo obtained by Fox News Digital.

The memo indicates that the VA will revert to a medical benefits package that does not include abortion services, as these are considered “not necessary” under the law established in the 1992 Act. The VA’s previous leadership opted to allow abortion services in light of the Supreme Court’s DOBBS decision, which overturned Roe v. Wade, but that allowance is now being rescinded.

A representative outlined that the 1992 Veterans Health Care Act permits various health services for women, including tests and general reproductive care, but excludes infertility services unless they are connected to pregnancy risks. It seems, then, that the current environment is steering the VA back toward longstanding legal precedents that have traditionally limited abortion access.

According to a VA spokesperson discussing the policy shift, federal law and historical practices have typically constrained the VA’s ability to provide abortion counseling and services, regardless of the administrative party in power. The spokesperson emphasized that the agency’s new rules align with pre-Biden bipartisan policies.

The memo also highlights that the intent of referencing the DOBBS decision is to limit federal overreach, shifting the oversight of abortion policy back to state jurisdictions. The agency is keen to underline that the newly reinstated policy would not hinder care for pregnant women facing life-threatening conditions.
