Victor Davis Hanson Observes Courts Appear Unresponsive to Biden’s Border Situation Impacting Millions of Americans

Victor Davis Hanson, a senior fellow at the Hoover Institute, expressed concerns on his show Thursday, suggesting that the court does not consider how the Southern border crisis under the Biden-Harris administration affects Americans.

During former President Joe Biden’s administration, the U.S. experienced the highest level of net immigration on record, with around 2.4 million illegal immigrants entering annually from 2021 to 2023.

“I just don’t get how you manage to bring in 10 million people without any proper checks. You’re dismissing unvaccinated military personnel, but what about the health status of these undocumented immigrants? Like, I wonder if they’re vaccinated or if they could be carrying tuberculosis,” Hanson remarked. “It’s odd, isn’t it? I mean, what about the 500,000 immigrants that could be involved in criminal activity?”

He continued, “You have all these individuals arriving, and roughly 75% of them are simply detained and given paperwork without any hearings. They’re all here illegally — there’s no question about that. They broke the law on their way in, and I just can’t fathom why law enforcement can’t just go in and take one individual, respectfully.”

On Monday, the Supreme Court decided that the Trump administration could lift the injunction that prevented the Department of Homeland Security from revoking Temporary Protected Status (TPS) for Venezuelan citizens.

The lawsuit regarding TPS for Venezuelans will proceed in lower courts.

Hanson expressed confusion regarding the Biden administration’s approach, questioning why illegal immigrants weren’t formally invited but instead seemed to arrive “with immunity, free to break the law.”

“We can talk all day about how great the laws are, but will there be any guidance on managing 10 million people that entered illegally in the last four years?” he asked. “Do courts really think a $40 million hearing is necessary for each of those individuals? Is that the plan? Do they even care about the practical implications of their decisions?”

Since taking office, Trump has issued several executive orders to tackle illegal immigration and bolster border security, although many of these orders have been challenged in lower courts.

In March, U.S. District Judge James Boasberg temporarily blocked a decision related to the Alien Enemy Act of 1798. The Supreme Court later took over the case, pausing Trump’s attempts to deport members of a Venezuelan prison gang.

Hanson questioned whether the courts comprehend the ramifications for communities that absorb illegal immigrants and noted that affluent areas, like Malibu and Brentwood, haven’t faced these issues as directly.

“It seems like the courts might not be fully aware of the consequences — it’s a serious situation that impacts millions of people, now and in the future,” he stated.

“Mallorcas should have faced consequences. There may not have been votes, but Biden should have been held accountable for this. He really should have. They allowed a deterioration of the border for political gain. It seems no one cared, and the courts remained uninvolved.”
