In a groundbreaking use of AI, the family of a man who lost his life in a road rage incident in Chandler, Arizona, created a victim’s impact statement featuring the deceased’s voice and likeness. The AI video addressed the killer, with the message, “perhaps we were friends in another life.”

ABC15 reported that Christopher Perky, a 37-year-old Army veteran, was tragically killed in 2021 during a road rage altercation near Gilbert and German Road in Chandler.

This AI-generated video is reportedly the first of its kind in the United States, showcasing Perky’s image and voice to share his perspective on his life and the moment he met Holcasitas. It incorporated actual footage from Perky’s life, revealing his personality and humor, while addressing his killer directly.

“In another life, we could have been friends,” the AI version of Perky stated to Horcasitas. “I believe in forgiveness…” The video also displayed a photo of him enhanced with an “old-age” filter.

Judge Todd Lang responded positively to the video during the court proceedings, expressing, “I love that AI. Thank you for it. It felt genuine. Mr. Holcasitas’s notable forgiveness reflects the character I heard today.”

Stacey Wales, Perky’s sister, remarked that the AI representation truly captured her brother’s spirit and conveyed his sentiments as a murder victim. The video significantly influenced the court’s decisions, and the judge referenced it in his sentencing. Ultimately, Horcasitas received a sentence of 10.5 years for manslaughter, which was longer than the state’s suggested nine-and-a-half-year sentence.

The implementation of AI in this case not only helped the Perky family seek justice but also offered them a sense of closure and healing. Wales expressed gratitude to her child for creating the video, saying, “I needed to hear from my uncle Chris in the end.”

While the use of AI in legal settings is still relatively new, it has the potential to enhance efficiency and assist those less familiar with legal procedures in presenting their cases more effectively. However, Arizona Supreme Court Justice Timmer cautioned that AI must be utilized responsibly to avoid disrupting or compromising justice.

Justice Timmer commented:

AI holds the promise of significant efficiency within the judicial system, potentially aiding those less informed about legal processes in articulating their cases. That’s why I am eager about AI’s possibilities. Yet, misapplication of AI could hinder or jeopardize justice. A balanced approach is essential. Accordingly, courts have formed an AI committee to examine its use and recommend best practices. Ultimately, those employing AI, including the courts, bear the responsibility for its accuracy.
