Texas Man Sues Whataburger Over Unwanted Onions
A man from Texas has filed a lawsuit against Whataburger after claiming that his meal included onions, despite his request for an onion-free order.
The lawsuit was submitted last month by Demarie Wilson in Harris County’s 269th Judicial District Court. According to the documents, Wilson ordered a “fast food meal” at a Whataburger on July 24, 2024, specifically asking for no onions.
However, he alleges that onions were indeed included in his meal, leading to an “allergic reaction” that required medical attention. Wilson stated that he had to see a healthcare professional due to this incident.
In response, Whataburger denied Wilson’s claims in court filings from May 16. They are demanding “strict evidence” to back up his assertions.
A representative for Whataburger mentioned they had no comment on the ongoing lawsuit. Attempts by media to contact Wilson’s attorney for more insights were also made.
The court documents do not specify what Wilson ordered. However, menus typically indicate that the classic Whataburger consists of a beef patty topped with mustard, tomato, lettuce, pickles, and diced onions.
Interestingly, Whataburger’s website lists allergens like gluten and milk but, notably, does not mention onions.
Wilson is seeking over $250,000 in damages—though it’s noted he aims for a total below $1 million. The lawsuit claims that Whataburger is fundamentally liable for producing food that is “flawed and unjustly dangerous.”
This isn’t Wilson’s first dispute with a fast-food chain. He previously sued Sonic, alleging that an onion was included in his burger order as well.
