A New York judge has ruled that a handful of social media companies must accept a lawsuit from survivors of the 2022 Buffalo grocery store shooting that killed 10 people.
An Erie Supreme Court judge has ruled that social media companies, including YouTube, Meta, and Reddit, should hold their own and many others accountable for supporting the activities of Peyton Gendron, who was fired at the 2019 Topps Friendly Market. The court ruled that the defendants must face the lawsuit filed against them. On May 14, 2022, a racially motivated shooting occurred.
“At this stage of the case, the court must base its decision on the allegations in the complaint, not on the ‘facts’ asserted by the defendant in briefs during oral argument,” wrote Erie Superior Court Judge Paula L. Feroleto. is writing. at her command Defendants’ motion to dismiss was denied.
The plaintiffs, who include the families and survivors of the shooting victims, argued that the platform was “a negligent, defective, and harmfully designed ‘product’ that caused Gendron to become material, and therefore subject to product liability theories.” shall be held liable based on the
Gendron pleaded guilty to state murder and domestic terrorism charges in November 2022 and was sentenced to life in prison last year. Plaintiffs filed suit against social media platforms last year, alleging that they gave the shooter a platform for racist and violent views.
Feroleto dismissed claims that social media companies merely act as bulletin boards for third-party content. The defendants argue that they are not liable under Section 230 of the Communications Decency Act or the First Amendment.
“The court finds that the complaint alleges a sufficient cause of action to proceed at this stage of the litigation,” the order states.
Everytown, an advocacy group that promotes gun reform and is one of the plaintiffs, praised the judge’s order in a statement.
“For too long, social media companies have evaded accountability by hiding behind Section 230 and claiming immunity for the content they distribute.” Said Eric Tirschwell, Executive Director, Everytown Law Firm.
“We must hold accountable all the bad actors who prepared and equipped shooters to target and kill members of Buffalo’s Black community,” he added.
A Reddit spokesperson confirmed that the company plans to appeal the judge’s decision.
“Hate and violence have no place on Reddit. Our site-wide policy is to prohibit content that promotes hatred based on identity or vulnerability, as well as encouraging, glorifying, or inciting violence or physical harm against individuals or groups. “We explicitly prohibit content that calls out, or calls out,” the spokesperson said.
