Trump's Officials Use Medicaid Information to Assist ICE in Locating Migrants

Representatives of former President Donald Trump have finalized an agreement allowing ICE agents to access government Medicaid data, as reported by the Associated Press.

This new arrangement means “ICE will utilize CMS [Centers for Medicare & Medicaid Services] Data, which enables ICE to obtain identity and location information about individuals identified by ICE,” according to the agreement. Reported on Thursday, there’s more to this:

Tricia McLaughlin, who serves as the assistant secretary of the department, mentioned that both agencies issued a statement indicating they are “exploring initiatives to prevent illegal foreigners from accessing Medicaid benefits meant for law-abiding Americans.”

It’s estimated that millions of undocumented immigrants provide personal information to access taxpayer-funded Medicaid services, typically through emergency rooms and state-run clinics.

The data, interestingly enough, hasn’t been directly transferred to ICE. Instead, ICE is allowed to confirm identities and addresses during regular working hours.

This sharing of information reflects Trump’s move to eliminate many bureaucratic hurdles that hinder the enforcement of immigration laws.

Unlike previous administrations that restricted the use of such data for law enforcement purposes, Hannah Kucchi, a former CMS official during the Biden era, offered insights into the current sharing of information:

“It’s hard to believe that CMS would compromise the trust of Medicaid subscribers like this,” Kucchi commented, noting that personally identifiable information hasn’t generally been shared outside government agencies for law enforcement to investigate issues like waste or fraud in the program.

In an email exchange obtained by AP titled “Hold DHS Access – Emergency,” CMS Chief Legal Officer Rujul H. Desai proposed that they should first seek a direct appeal from the Department of Justice to “suspend” information sharing. The following day, HHS attorney Lena Amanti Yueh responded, noting that the DOJ was “satisfied that CMS is prepared to provide DHS access.”

A group of 20 democratically run states is taking legal action against the federal government to conceal the identities of undocumented immigrants utilizing taxpayer-funded health care systems.

“This is about turning data into a weapon, and it has to stop,” stated Representative Pramira Jayapal (D-WA), who has immigrant roots in India.

Federal law mandates that all states provide emergency Medicaid services. This emergency aid is specifically for life-saving services in emergency rooms and is accessible to all, including non-citizens. Many immigrants, regardless of their legal status in the country, rely on this.

Seven Democratic-governed states have full access to Medicaid programs within their jurisdictions, which include California, New York, Colorado, Washington, Oregon, Illinois, and Minnesota. These programs were initiated during Joe Biden’s administration, with a commitment to not charge the federal government for the medical expenses incurred by immigrants.

The transactions around information sharing are ongoing, especially as Democrats and their supporters raise concerns regarding ICE enforcement.
