Trump Labels Brazil a National Security Risk, Enacts Sanctions on Rebellious Supreme Court Judge

US Designates Brazil as a National Security Threat

On Wednesday, the Trump administration labeled Brazil a national security threat, announcing human rights sanctions against Judge Alexandre de Moraes of Brazil’s Supreme Federal Court (STF).

The U.S. Treasury Department’s Office of Foreign Assets Control (OFAC) took action under the global Magnitsky Act, citing de Moraes for a pattern of persecuting conservative political activities. This includes arbitrary detentions, denial of fair trials, censorship, and other severe human rights violations.

Due to these sanctions, all U.S. assets belonging to de Moraes are frozen, and any U.S. transactions involving him or his property are prohibited.

Scott Bescent, the Treasury Secretary, accused de Moraes of leading an “illegal witch hunt” against Brazilian citizens and businesses, stating, “De Moraes is responsible for censorship, arbitrary detention, and repressive campaigns against former President Jair Bolsonaro. Today’s action underlines our commitment to defending our interests and civil liberties.”

Marco Rubio, Secretary of State, echoed this sentiment, stating that de Moraes has used his authority for targeted efforts to silence political opponents through secretive orders impacting online platforms, including American social media companies.

De Moraes, who has been a prominent STF member since 2017, identifies himself as a crusader against “fake news.” Over the years, he’s spearheaded actions against what he terms “digital militias” that he believes undermine democracy. His actions include targeting former President Jair Bolsonaro and supporters of conservative political views.

The sanctions also cover measures that de Moraes has sanctioned, such as freezing bank assets and implementing travel bans.

President Trump stated that de Moraes has committed numerous judicial abuses, resulting in sanctions that include a 50% tariff on Brazilian goods entering the U.S., effective August 1. The president characterized Brazil’s recent governmental actions as a threat to U.S. national security and an economic risk.

He explained further, “These judicial actions, which claim to fight ‘disinformation’ or ‘hate content,’ threaten U.S. companies by coercing them into censoring political speech, thereby jeopardizing both U.S. interests and human rights.”

Trump noted the STF’s actions against Bolsonaro and free elections as catalysts for the tariffs. Just days prior, Rubio had mentioned similar concerns regarding U.S. visa restrictions on de Moraes and Brazilian officials.

The STF released a statement in support of de Moraes, contending that all decisions he made against Bolsonaro were constitutionally sound and confirmed by credible sources.

While de Moraes hadn’t publicly commented on the sanctions, reports suggest he is preparing a speech to address the situation, which would be delivered as the Supreme Court resumes work.

Meanwhile, leftist Brazilian President Luis Inacio Lula da Silva expressed solidarity with de Moraes, criticizing what he called unwarranted U.S. interference in Brazil’s judicial affairs. He defended de Moraes’ censorship actions as necessary for regulating content that affects Brazilians.

Lula’s presidency was bolstered by de Moraes’ censorship actions during the 2022 election campaign, which aimed to limit Bolsonaro’s attacks. Lula narrowly defeated Bolsonaro in that election.

Lula denounced the new U.S. tariffs as “unfair” and indicated Brazil’s willingness to negotiate its trade relationship with the U.S.

“We are increasingly integrated with major international markets,” Lula noted, adding that measures are being assessed to support Brazilian workers and businesses.

Interestingly, de Moraes attended a local soccer match on the evening the sanctions were announced. Reports indicated he appeared relaxed, smiling and even gesturing at the crowd during the game.

Commentators noted his dual role amidst these tensions, highlighting how politics can sometimes blend unexpectedly with everyday life.
