Dershowitz Suggests Federal Oversight Amid Allegations of Political Misuse of Legal System

On Monday, Alan Dershowitz appeared on Newsmax, discussing the possibility of federal intervention to ensure state officials are held accountable for what he views as politically charged abuses of the legal system.

The Office of Special Counsel (OSC) initiated an investigation on Saturday into whether special advisor Jack Smith breached the Hatch Act by engaging in prohibited political activities while overseeing two criminal probes related to President Donald Trump’s 2024 campaign. During his appearance on “The Record with Greta Van Susteren,” Dershowitz specifically highlighted the actions of New York District Attorney Alvin Bragg and New York State Attorney General Letitia James, implying that their conduct might warrant federal examination.

“When Bragg and James act in ways that seem to abuse the Constitution, I believe it opens the door for federal oversight of state officials,” Dershowitz commented. “I’m not advocating for criminal prosecution—I’m not a fan of it—but I think innovative lawyers could explore avenues for civil accountability regarding the misuse of the legal system for political ends.”

On the topic, Dershowitz mentioned he was open to a suggestion from Greta Van Susteren to send an email clarifying his views.

“I’m on board with that. In situations where there are lower-level staff willing to testify about Smith’s motivations, showing intent in New York shouldn’t pose a challenge,” he noted.

Dershowitz also criticized what he characterized as the politicization of legal and criminal systems.

“They boasted about their strategy. They operated in a context where they sought to weaponize legal and criminal frameworks for their political gain. It was quite straightforward in New York, but these actions don’t reflect a national standard,” he stated.

In June 2023, Smith charged Trump with mishandling classified documents, including a significant 31-count espionage violation. Another indictment followed in August 2023, with Trump facing four felony counts tied to his alleged efforts to overturn the 2020 election results.

In July 2024, Judge Eileen Cannon dismissed the Classified Document Case, ruling that Smith’s appointment was inconsistent with the appointment clause of the US Constitution. After Trump won the 2024 election, Smith paused election-related lawsuits, diverging from long-standing Department of Justice protocols.
