President Donald Trump’s latest executive order, aimed at addressing flag-related issues, received unexpected criticism from conservatives on Monday.

The order, announced on Monday, tasks the Attorney General with prosecuting violations involving the flag and clarifying First Amendment rights connected to such issues. Additionally, it instructs Attorney General PAM Bondi to initiate legal action against local governments regarding violations tied to flag extortion.

This action comes after months of protests where demonstrators burned American flags during anti-Israel and anti-ICE rallies.

While many conservatives have historically defended flag-burning as a form of free speech, Trump experienced a notable backlash from the right on social media following the order’s announcement.

Some critics expressed their frustrations openly. For instance, one radio host remarked, “It’s ridiculous to ban the burning of a flag. It contradicts the principles of free speech.” Others shared similar sentiments, stating that while they personally oppose flag burning, they believe the government shouldn’t dictate such expressions of speech.

Conservative commentator Eric Ericson noted, “I see the intent behind this order, but burning the flag falls under free speech, and I don’t think the executive branch can legislate what constitutes crime.” A Redstate author also lamented a time when presidential actions didn’t infringe on constitutional rights.

Considering further perspectives, some conservatives defended the order, suggesting it doesn’t imply an outright ban on flag burning. They interpreted the text as focusing on specific circumstances, particularly where flag burning could incite violence.

For instance, Chrisulfo, a senior fellow at the Manhattan Institute, commented, “After reading the full text, it doesn’t criminalize flag burning, nor does it violate free speech rights. It’s important not to overreact.” Meanwhile, a White House spokesman, Taylor Rogers, asserted that the order seeks to prevent the American flag from being used as a means to incite violence that threatens public safety.

It’s important to note that the Supreme Court’s 1989 decision in Texas v. Johnson determined that flag burning is a form of symbolic speech protected under the First Amendment. Given this context, the legal implications of enforcing the new order may face significant challenges under existing precedents.

Trump’s executive order emphasizes prioritizing the enforcement of laws against flag burning in instances involving violence, hate crimes, or illegal discrimination. Overall, the situation underscores a complex intersection of patriotism, free speech, and legal interpretation in contemporary discourse.
