Federal appeals court supports Trump administration, removes restrictions on ICE actions in Minnesota

Federal Court Backs ICE Tactics Amid Protests

A recent ruling from a federal appeals court has sided with the Trump administration, effectively blocking new restrictions on how U.S. Immigration and Customs Enforcement (ICE) agents can operate in Minnesota, especially when facing anti-ICE protests.

As confrontations between anti-ICE demonstrators and law enforcement agencies persist, a three-judge panel from the 8th Circuit Court of Appeals overturned a previous court ruling that had prevented police from arresting, detaining, or using non-lethal tactics like pepper spray against protesters in Minneapolis without probable cause.

The appeals court reviewed evidence similar to what the lower court considered. In their decision, they noted, “What they show is that observers and protesters are engaging in a wide range of actions, some of which are peaceful, but many of which are non-peaceful. They also show that federal officers are responding in a variety of ways.”

The lawsuit claims that six protesters had their civil rights violated by federal authorities.

Just last week, a court had lifted constraints on ICE’s use of force against protesters in Minnesota. U.S. Attorney General Pam Bondi reacted to the recent ruling, indicating that it provides him with a “full stay.”

In her statement, she argued that “Liberal judges sought to handcuff federal law enforcement officers, restrict their movements, and jeopardize their safety when responding to violent instigators.” She emphasized the Department of Justice’s efforts to ensure that law enforcement is not undermined.

A prior ruling from U.S. District Judge Kate Menendez had granted a preliminary injunction supporting the protesters’ claims against DHS and ICE regarding their treatment during immigration raids.

Menendez had indicated that the claims concerning violations of the First and Fourth Amendment rights had strong merit. She also referenced several incidents where ICE agents allegedly used excessive force against individuals who were merely observing or participating in peaceful protests.
