Babylon Bee Wins Key Free Speech Case in Hawaii

On Friday, the Babylon Bee, a satirical news website, celebrated a significant win for free speech, supported by the Alliance Defending Freedom.

A federal judge recently blocked a law from Hawaii Governor Josh Green (D) aimed at banning the “reckless distribution of materially deceptive media.” This law, enacted in 2024, was designed to limit content that could tarnish a candidate’s reputation or sway voting behaviors. The rationale was that misleading information could potentially influence elections.

Under the law, videos and other media would be required to have clear disclaimers. However, the ADF argued that such disclaimers detracted from the Babylon Bee’s comedic intent and function. Those found guilty of breaching the law could face imprisonment, hefty fines, or lawsuits.

The legislation specifically targeted AI-generated images, which Babylon Bee frequently utilizes.

Section 1 of the bill acknowledges that while artificial intelligence can offer societal benefits, it also poses risks, particularly in elections through deepfakes that could spread misinformation and escalate political tensions.

Seth Dillon, the CEO of Babylon Bee, stated, “This decision is a victory for anyone who cherishes the First Amendment and the right to discuss political matters without government interference.” He expressed gratitude towards the ADF for their support in opposing laws that could stifle comedy.

The Babylon Bee has gained immense popularity across social media, attracting over 2 million followers on Instagram and more than 5 million on X.

Matthew Hoffman, ADF’s general counsel, emphasized that humor and satire have long been crucial for conveying truths while enjoying robust constitutional protections. He welcomed the court’s decision as a step back from what he described as Hawaii’s “war on political memes and satire,” asserting that the state cannot dictate acceptable political discourse.

U.S. District Judge Shanlin Park, nominated by President Joe Biden in 2023, reiterated that political expression is crucially protected under the First Amendment. She criticized the law for imposing risk assessments based on subjective judgments, which could lead to biased applications of the law.

President Park ruled that the state cannot censor political speech simply because it finds it unpalatable. She noted, “The Babylon Bee and its creators engage in parody and humor, contributing to political dialogue through exaggerated and fictionalized content.”

Additionally, the ADF pointed out that Babylon Bee has previously succeeded in a similar lawsuit against California’s attempts to regulate social media companies regarding misinformation. As for Hawaii’s case, the state’s attorney general’s office has stated they are reviewing the ruling but offered no further comment.
