DHS shutdown halts ICE oversight efforts as Democrats withdraw their support

DHS Oversight Suspension Amid Funding Standoff

The Department of Homeland Security’s (DHS) internal watchdog has had to pause many of its immigration enforcement oversight activities due to uncertain funding, as Democratic support remains elusive for financing Cabinet-level agencies.

A representative from the DHS Office of Inspector General (OIG) mentioned on Wednesday that most audits and inspections, particularly those involving Immigration and Customs Enforcement (ICE), are currently on hold amid the ongoing partial government shutdown.

Democrats have been pushing for more scrutiny of ICE since the Trump administration increased federal enforcement presence in various cities to address illegal immigration. However, this has led to the suspension of at least seven internal DHS investigations into ICE’s actions, following Democrats’ withdrawal from a bipartisan funding agreement for the department.

The spokesperson clarified, “Most OIG audits, inspections, and similar reviews… are suspended while appropriations expire. A small number of OIG audits related to disaster relief continue as they are supported by existing appropriations.”

Nevertheless, OIG criminal investigators are still at work despite the furlough, but no specific details about ongoing criminal investigations have been revealed. The investigations that have been paused include inquiries into whether ICE will address allegations concerning excessive force and ensuring compliance with detention standards.

Additionally, investigations into the practices of Customs and Border Protection (CBP) officers have also been halted, particularly regarding whether their domestic operations align with DHS policies and federal laws.

This pause in investigations is significant, especially considering the recent incident where a CBP agent shot and killed U.S. citizen Alex Preti during a protest against ICE in Minneapolis last month. Following that event, Democrats have strongly called for further investigations and stricter regulations.

Both Preti’s death and another related case have been emphasized by Democrats as critical reasons for their withdrawal from the initial funding agreement aimed at supporting DHS operations for the fiscal year.

The original DHS funding bill did pass through the House but ultimately failed in the Senate. This bill proposed new training requirements for ICE and mandated the use of body cameras for federal enforcement agencies. However, Democratic leaders believe these measures aren’t sufficient and have rejected a recent compromise proposal from the White House.

Reportedly, Democrats presented a counterproposal to Republicans this week, yet progress toward consensus appears to remain stagnant.

Among other demands, Democrats are insisting on judicial warrants for ICE enforcement actions and calling for ICE agents to be visibly identifiable without masks. These proposals have been met with significant backlash from Republican circles.

It’s essential to note that this extended shutdown not only affects ICE oversight but also jeopardizes funding for various other agencies under DHS, including the Transportation Security Administration (TSA) and the Federal Emergency Management Agency (FEMA).
