Supreme Court unanimously supports Big Oil in environmental case from Louisiana parishes

Supreme Court Rules in Favor of Oil Companies in Louisiana Case

Several lawsuits are claiming billions from oil companies due to environmental harm in coastal Louisiana. Recently, the United States Supreme Court declared a significant victory for these companies.

In an 8-0 ruling, the court decided that one of the lawsuits would be transferred from state court to federal court, which many see as a more advantageous setting for oil interests.

Interestingly, Justice Samuel Alito did not participate, having resigned due to his stock holdings in ConocoPhillips. Meanwhile, the oil companies argued that their historical provision of aviation fuel for the federal government during World War II justified the federal court’s jurisdiction. All justices were in agreement with this viewpoint.

Justice Clarence Thomas stated that the arguments fit the usual definition of a case related to federal obligations. This decision, which overturned a prior ruling from Louisiana’s Fifth Circuit Court of Appeals, could have broader implications for other lawsuits where dioceses are pursuing claims against energy companies for environmental damage.

Republican Louisiana Attorney General Liz Murrill, part of the case as a plaintiff, expressed confidence in her ability to prevail against the oil firms, despite this roadblock. Murrill pointed out a past jury’s ruling that held Chevron USA liable for $740 million in damages to Plaquemines Parish.

Even Louisiana’s Republican Governor, Jeff Landry, who normally supports the oil industry, backs the lawsuit. “Simply relocating the case won’t deter our aim to hold Big Oil accountable for their harm and the remediation owed to Louisiana’s residents,” remarked John Carmouche, an attorney representing local officials.

In a broader context, Mike Howell, president of the Oversight Project, noted that this Louisiana lawsuit contradicts the energy independence principles promoted during President Trump’s administration. He highlighted that Republican actions in Louisiana seem to clash with their stated priorities.
