Tennessee man claims he attempted to fix IRS mistake, then faced interest charges

IRS Sends Incorrect Tax Refund to Tennessean

A man from Coopertown, Tennessee, encountered significant trouble when the IRS issued him a $20,000 tax refund by mistake. His attempts to return the funds led to a frustrating ordeal filled with delays and unexpected interest charges, ultimately culminating in a new tax refund this year.

Wilson Perry Kirby, 76, who previously worked for the Montgomery County Highway Department, refers to himself as a straightforward, uncomplicated country guy. He received the erroneous refund on May 10, 2022, and sought to rectify it immediately. Despite an accountant’s assistance, he faced numerous obstacles.

“None of us made a mistake; it was clearly their error,” Kirby stated.

After years of navigating the bureaucracy, Kirby reported that not only did the IRS impose interest on the money he attempted to return, but they also withheld his full refund this year. “It was devastating. I cried,” he shared.

The IRS, citing privacy laws, has declined to comment on the specifics of Kirby’s situation. Seeking guidance, Kirby reached out to officials at various levels, from presidents to local governors and mayors, only to find little support. “They loved asking for votes, but when I needed help, no one was there,” he reflected.

Since losing his wife, Norma Jeane, in August 2024, Kirby has largely fought this battle alone. “She was tech-savvy; she knew how to use a computer. I don’t even know how to turn one on,” he said. “If she had been around, things might have been different.”

Progress began when he sought assistance, and he now expects the situation to be resolved by year’s end. “Without that help, I don’t know where I would be now,” he acknowledged.

Throughout this process, Kirby has been his own advocate, a testament to his determination—something he attributes to his stubborn nature. “I’m set in my ways. Maybe that’s played a role,” he admitted.
