On Wednesday, a Brooklyn judge again released a deranged suspect accused of punching a 57-year-old mother of three, breaking her jaw, even though prosecutors upgraded the assault charge to a felony.
Prosecutors say Franz Judy, 33, has been on bail-enabled charges including second-degree assault for more than a month after randomly attacking bus assistant Dulce Pichardo in Crown Heights. He remained on supervised release after being charged.
The Brooklyn District Attorney’s Office requested $25,000 cash bail or $50,000 bond for the increased charges, but Brooklyn Supreme Court Judge Matthew Sciarrino denied the request.
Prosecutors said Judy allegedly shoved a sock into Pischardo’s face on March 24 for no apparent reason, causing fractures on both sides of Pischardo’s face and knocking out several teeth.
After Pischardo was beaten, she ran to her brother’s restaurant nearby and pointed out her alleged attacker.
The brothers chased Judy for several blocks and subdued him until police arrived.
“This random attack on a stranger, especially a woman, is beyond senseless and completely unacceptable,” District Attorney Eric Gonzalez said in a statement.
“After reviewing all the evidence, the grand jury returned an indictment for felony assault. We will hold the defendant accountable to ensure that he does not repeat such outrageous criminal conduct in the future.”
Jeudy was initially charged with misdemeanor non-bailable assault, but was later charged with a more serious charge that could carry up to seven years in prison if convicted. .
He also faces second-degree assault, third-degree assault and related charges.
The district attorney’s office said it upgraded the charge to a felony based on a review of the evidence and the extent of her injuries.
“This is terrible. I don’t want this to happen to anyone else,” Pichardo told the Post in March.
A spokesperson for the Administrative Office of the Courts declined comment Wednesday night, referring the Post to court records when asked about Judge Sciarrino’s decision not to jail Judy ahead of her trial.
Sciarrino faced a tough situation last year when he ignored prosecutors’ requests to keep the career criminal behind bars and instead granted bail in an attempted murder case.
The suspect, Ousmane Diallo, shot and wounded two people after being released on $500,000 bail, authorities said at the time.
Judy has been arrested for two other random punches, one for assaulting a law enforcement officer in 2018 and one for assaulting a security guard in 2019, law enforcement sources previously told the Post. Ta.
