The Republican National Committee filed a federal lawsuit Friday to prevent Nevada from counting mail-in ballots received after Election Day, as current state law allows.

Democrats enacted rules in 2021 that would allow mail-in ballots to be counted up to four days after Election Day, as long as the envelopes are postmarked by the end of the day.
according to Associated Press“The complaint also states that this provision assumes that envelopes received three days after Election Day and not postmarked to the contrary are mailed in time.”
Republicans say this violates the U.S. Constitution, which requires voting to be held on a single day.
“Nevada’s deadline for receiving ballots clearly violates federal law and undermines the integrity of our state’s elections,” RNC Chairman Michael Whatley said in a statement. “Ballots received several days after Election Day should not be counted.”
Republicans also want to repeal laws in Mississippi and North Dakota that allow votes received after Election Day to be counted. This indicates not only the party’s focus on election regulation but also increased activity surrounding election-related litigation.
But Republicans are not alone in their deep distrust of the electoral process.

Ballots received after Election Day will be counted in 19 states, including Nevada.
