‘Real Conflict’: Fox News Panel Questions If Supreme Court Will ‘Step In’ On New York Trump Case

Fox News host Laura Ingraham and two legal experts discussed the possibility of the Supreme Court intervening in former President Donald Trump’s New York lawsuit following his ruling.

Legal analyst Sol Weisenberg and Chris Landau, a former clerk to two Supreme Court justices, appeared on “The Ingram Angle” to discuss the aftermath of President Trump’s conviction. (RELATED: ‘Vote Fraud’: The Death of the American Voter | WATCH NOW)

“But this is an unusual and historic event. Does that open the door to other events that the court may not want to happen?” Ingram asked.

“If they did do that, I think it’s incredibly unlikely,” Weisenberg said. “It would be, as you said, doing something like Marchan significantly interfering with his campaign regarding the terms of his release pending appeal, which could raise constitutional questions. But, Laura, in addition to not wanting to have politically charged cases, they don’t like to interfere in state criminal proceedings before that happens, either at the trial or appellate level.”

“Yeah, but what if Marc did it?” Ingraham asked. “The question is, Chris [in]Marchan is interfering with the campaign process. What if he was told on July 11 that he couldn’t work with someone in Florida to campaign outside of New York without the express permission of his probation officer? He probably would have said yes.”

“That would give them an opportunity,” Weisenberg said, “and I still think it’s unlikely. But it would give them an opportunity, because you’re creating a real conflict between someone’s right to field a candidate to effectively run a party in a presidential election and the state’s judicial system. But it’s still unlikely.”

“Obviously, it’s unlikely, but this is an extraordinary case that’s unprecedented in American history,” Landau said. “This is not a normal criminal case. I mean, I understand that in a run-of-the-mill case, Sol is right. But I think the U.S. Supreme Court is currently dealing with presidential immunity cases. They’re very familiar with these issues.”

“Again, they are the United States Supreme Court, and all the others are New York State courts,” Landau continued. “The United States Supreme Court is uniquely qualified to recognize the federal government’s compelling interests here. I am very concerned about the idea that Mr. Trump will spend six weeks in front of Judge Marchan awaiting a ruling while everyone else waits with their fingers crossed. Because right now he’s sitting in Judge Marchan’s courtroom with a ‘Kick Me In’ sign on his back.”

A New York jury found Trump guilty of all 34 felony charges brought by Manhattan District Attorney Alvin Bragg, who alleged that Trump directed his former lawyer, convicted liar Michael Cohen, to make hush money to porn actress Stormy Daniels and then agreed to repay the payments through falsified business records.
