RNC, Trump Campaign, Nevada GOP Sue over Mail-in Ballot Practices

The Republican National Committee (RNC), former President Donald Trump’s campaign and the Nevada Republican Party filed a lawsuit alleging that Nevada counted mail-in ballots that arrived the day after the election and did not have a postmark.

In the Press release The Republican National Committee explained Monday that state law requires that mail-in ballots “be postmarked on or before Election Day.” Republican National Committee Chairman Michael Whatley said “counting ballots” after Election Day “poses concerning and potential fraudulent hazards” to the state’s election.

The RNC explained that this would ensure that “votes received after the election will not be counted in the results.”

“Counting ballots that are not postmarked after Election Day poses concerning and potentially fraudulent consequences for Nevada’s elections,” Whatley said in a statement. “I am filing this lawsuit to ensure that Nevada law is followed and that election integrity is promoted in the Silver State.”

“We found that Nevada election officials routinely counted unpostmarked mail-in ballots received after Election Day, in violation of the law,” the RNC press release added.

In Litigation In a lawsuit filed last month against Nevada Secretary of State Francisco, Washoe County Elections Supervisor Karian Burgess, Washoe County Clerk Jean Galassini, Clark County Elections Supervisor Lorena Portillo and Clark County Clerk Lynn Marie Goya, the Republican National Committee, the Trump campaign and the Nevada Republican Party said the purpose of the lawsuit was to “enforce one of the key elements of Nevada’s post-Election Day vote counting.”

Former Nevada Governor Steve Sisolak (Democrat) Signed Assembly Bill (AB) 321 went into effect in June 2021, making the practice of mail-in voting permanent in the state.

AB 321 would allow ballots mailed within four days of an election to be counted in the results. according to To the Daily Indy.

“We are committed to ensuring the integrity of Nevada’s elections and promoting voter confidence,” Nevada Republican Party Chairman Michael McDonald said in a press release. “Allowing unmarked ballots to be illegally counted undermines both. We will continue to fight to ensure fair elections for all Nevadans, that only legal votes are counted, and that our system is secure.”

Similar lawsuits have been filed in Mississippi and North Dakota over the counting of mail-in ballots received after Election Day.
