Immunity Decision Will Let Presidents Go After Political Opponents

Democrats suggested Monday that if former President Donald Trump returns to the White House following a Supreme Court ruling on presidential immunity, they could legally pursue political opponents. Trump vs. the United States

Van Jones, a Democratic activist and commentator, warned that the decision gave the president a “license to commit violence”.

As Breitbart News reported, the court held The 6-3 decision held that the president enjoys absolute immunity for his official acts but not for his unofficial acts. It is up to the courts to determine that distinction, but the Supreme Court said that the president has a right to pretrial challenge whether a particular act falls into the “official” or “unofficial” category.

Democrats have warned that a “MAGA SCOTUS” gives the president the power to eliminate political opponents. They appear to be following the lead of Justice Sonia Sotomayor, who wrote the dissenting opinion for the Supreme Court’s liberal wing.

The Supreme Court has effectively created a zone of exemption from the law around the president, upending a status quo that has existed since the founding of the country. This new immunity from official acts “is waving around like a loaded weapon” for any president who wants to put his own interests, political survival, or financial gain above the interests of the nation. … The President of the United States is the most powerful person in the country, and perhaps the world. If he uses his official office in any way, the majority reasoned, he is immune from criminal prosecution. Ordered Navy SEAL Unit 6 to assassinate a political opponent? Immunity. Organized a military coup to stay in power? Immunity. Accepted a bribe in exchange for a pardon? Immunity. Immunity, immunity, immunity. It’s OK for the president to break the law, to use the privileges of his office for personal gain, and to use his official office for nefarious purposes. Because if he knew he might one day be held accountable for breaking the law, he might not be as bold and fearless as we would like to be. That is the message of the majority today. Even if these nightmare scenarios do not come true — and I hope they never will — the damage has already been done. The relationship between the President and the American people has been irrevocably altered. In every exercise of civil power, the President is now a king above the law.

Meanwhile, Sotomayor appears to be repeating the arguments made by the Biden-Harris campaign.

Some Democrats were enthusiastic about what they saw as presidential immunity and openly hoped the Biden administration would use the military to remove President Trump.

Conservatives responded with derision, referring to reports of President Joe Biden’s frailty.

In arguing that Trump and other presidents can legally pursue their opponents, Democrats appeared to acknowledge that Biden was pursuing them illegally, at least according to the Supreme Court.
