A Honduran national who has faced multiple immigration custody arrests and been convicted of at least one assault offense is suspected of beating a man to death in Virginia earlier this month.
On July 20, a resident walking on a wooded trail near the 9500 block of Route 29 in Oakton, Virginia, saw “an unresponsive male lying on the ground,” according to Fairfax County police. SaidThe victim, later identified as Nicasio Hernandez Gonzalez, 47, of Fairfax, had “obvious” signs of “traumatic trauma” on his body and was pronounced dead a short time later, the statement added.
Following the uproar over immigration detention orders issued against “illegal” FCADC inmates like Guzman Videl, Fairfax County Sheriff Stacey Kincaid wrote a letter asserting that without a court warrant, a detention order is merely an “informal request.”
By Wednesday, three suspects had been arrested in connection with Gonzalez’s death: 27-year-old Maudin Anibal Guzman Vides, 45-year-old Wis Alonso Solto Portillo, and 20-year-old Wilmer Adli Guzman, who was arrested in Washington, D.C., and awaiting extradition to Fairfax County. All three were charged with malicious wounding by mob.
None of the suspects have permanent residence in the United States, and at least one of them, Guzman Vides, appears to have no legal right to be in the country in the first place.
Guzmán Vides, an undocumented immigrant from Honduras, has a long history with local and federal law enforcement. In November 2018, he was arrested by the U.S. Border Patrol after illegally entering the U.S. near Hidalgo, Texas. A year later, a judge ordered him deported.
It is unclear whether Guzman Vides was deported, but between October 27, 2022 and June 28, 2023, ICE Reportedly It filed multiple immigration detention orders against him with the Fairfax County Adult Detention Center, but ICE said the Fairfax County Sheriff’s Office refused to honor the detention orders. At least one of those detentions was linked to a particularly brutal incident in March 2023, when Guzmán Vides allegedly broke into a building and severely beat a woman. In June of that year, he was convicted of theft and assault and received an 11-month prison sentence with 364 days suspended.
On June 17, 2024, after serving his 11-month sentence, Guzmán Vides was released from prison. Nicasio Hernández González died about a month later.
According to WJLA, 725 “illegal aliens” were held in the county’s adult detention center in the past 12 months. Of those 725, only three were transferred to ICE custody.
Following uproar over immigration detention orders issued against “illegal” inmates in the county jail accused of egregious violent and sexual crimes, Fairfax County Sheriff Stacey Kincaid said: letter They argue that without a court warrant, detention is merely an “informal request.”
“ICE knows that if they want to detain these criminals, all they need is a judicial warrant authorizing the arrest,” her letter continued. “ICE is notified each time an illegal immigrant is detained, yet time and again, ICE makes no effort to obtain a warrant that gives them judicial authority to detain.”
“This inaction is not a failure of the sheriff’s office, it’s a failure of Immigration and Customs Enforcement,” Kincaid added.
The sheriff and other local elected officials have reportedly attempted to implement sanctuary policies in Fairfax County, according to her campaign. WebsiteKincaid also has the endorsement of several prominent Virginia Democrats, including former Governor Terry McAuliffe, former Rep. Jim Moran and current Rep. Gerry Connolly.
Sheriff Mike Chapman of neighboring Loudoun County has a decidedly different view on immigrant detention, saying he respects detention even without a warrant as a key part of keeping communities safe.
“We have to make sure we’re not allowing people in our communities who can do further harm,” Chapman told WJLA. “When we know they’re violent and we know they’re illegal, it just doesn’t make sense to me that we would allow them to stay in our community and then go on to commit another crime.”
