Arizona county faces lawsuit over alleged refusal to purge illegal immigrants from voter rolls

The America First Legal Foundation filed a lawsuit Monday against Maricopa County Recorder Steven Richer (R), alleging that the county has failed to remove illegal immigrants from its voter rolls.

copy of Litigationobtained by Daily Caller News FoundationThe suit claims that Richer and his office are “ignoring” county recorder maintenance requirements, noting that the state legislature adopted “stricter voter roll” requirements in 2022 to ensure the exclusion of foreign citizens. The adopted law requires monthly checks of local voter rolls to verify citizenship status and compare them to a federal database.

“[Richer] “They failed to take the steps required by law to remove alien citizens from Maricopa County’s voter rolls,” the lawsuit states.

“America First Legal is leading the charge to prevent illegal immigrants from voting in 2024,” Stephen Miller, founder of the AFL and former senior advisor to President Donald Trump, told DCNF.

“Maricopa County is in direct violation of state law by refusing to remove illegal immigrant voters from its rolls,” Miller said. “We are taking decisive action by filing a lawsuit against Maricopa County for unlawfully allowing illegal immigrants and alien citizens to interfere in our 2024 election.”

Recent Rasmussen Reports SurveySurveys cited in the AFL’s lawsuit found that just over 1% of voters in battleground states, including Arizona, identify as not being U.S. citizens.

The AFL had previously sent demand letters to all Arizona counties, including Maricopa County, asking them to clean up their voter rolls. The AFL said Richter’s lawyer responded that the office had already verified voters’ citizenship status and would take no further action.

However, in July press release AFL representatives argued that more than 35,000 Arizona voters had not provided proof of citizenship. The group noted that Arizona’s 2020 presidential election was decided by roughly 10,000 votes.

by New York PostArizona is one of at least 46 states that doesn’t require proof of citizenship to register to vote in federal elections. People who want to register can simply check a box indicating they’re a citizen. Arizona does require proof of citizenship to vote in state or local elections.

“How can Arizonans have confidence in the integrity of their state’s elections when the government officials in charge of administering elections aren’t even following the law,” James Rogers, senior legal counsel for the AFL, told the DCNF.

“Arizona residents are rightly concerned,” Rogers added. “This lawsuit is intended to restore public confidence by ensuring election officials follow the law and that foreign nationals cannot influence the outcome of our elections.”

The Maricopa County Recorder’s Office did not respond to DCNF’s request for comment.
